To prove false advertisement, you must be able to prove certain facts to be true. There are 5 requirements. The first one is the relevant fact to this case.
That being....a false statement of fact has been made about the advertiser's own or another person's goods, services, or commercial activity.
The seller stated what he was selling in the auction. That disqualifies this requirement.
No prosecutor in this country would even offer this case to a grand jury.
Yes....I think this is legal.
Congrats on finishing your first semester of law school. Couple more things you will learn in the next couple of years:
1. Illegal does not mean criminal. There are many laws that create liability that are not criminal. Any tort law, for example. Copyright laws are another example. Thus, no one cares what any prosecutor would do.
2. You don't need a grand jury for all criminal charges. You definitely don't need one for false advertising.

Heh, cool, and as with other similar storage technologies, a disc will take 123087012863018 hours to write and blank media will cost $120370860861 each for about the next 10 years. Still, cool!!!! nonetheless.

I guess we probably won't see any major change in the direction of OSX. I wonder what the science he wants to focus on could be?

Anyone from Bruges can meet up at the GCA in the Geldmuntstraat. There's a Leopard Night from 6pm to 8h30pm. There will be demos of Leopard (I don't have more information yet)

Ahh the man with the shaky hand from the Lion demonstration.
It's hard not to begin shaking using that terrible mouse(Magic Mouse). On a hot summer day it's really hard using it. Here in Denmark the summer is really moist. And because of the surface of the mouse, after a longer period of time sweat begins to assemble on top making the swipe features simply not work. You have to have totally dry fingers and palms for using that mouse.
My point is; Apple, stop making mice all together. You're terrible at it. get a deal with Logitech for instance and have them cook up a beautiful mouse to go with your design standards.
The Magic Trackpad has the same issues like the Magic Mouse has. If it's not cramps it's sweaty palms and fingers.
I felt Craig's pain when he was demoing Lion. I cringed, thinking that it was not the best way to demo the swipe features.
I'm doing it wrong? Story of my life. ;)

mmmm doesn't like streaming from tvcatchup.com
new frame twice a second but sound is ok. Vid card is Radeon 9000 with 64MB.
Is that the issue or the paltry 512MB ram?

can you believe that four game that are going for .99 cents used to cost like $5000.00 each as a large arcade console just 28 years ago? Damn!
Or $30 for a cartridge even.

Yeah not going to hurt samgsung on bit.
Apple needs Samsung more than Samsung needs Apple.
Reason being is the parts Samsung is supply there is already a shortage of them on the market. Apple drops them all Samsung does is go to the next guy and more than likely for more money.
Apple on the other hand will struggle to find a new supplier.
Don't be daft, Samsung are the suppliers because they gave the best price.
Samsung will also be locked into supply contracts anyway, and they interfered with them, Samsung would be in a world of hurt, not just from Apple and litigation, but every other company they supply.
And don't you believe there aren't alternatives for Apples component supplies either - every company that can build something that Samsung already does has been on the phone this week to Apple.
The end result in all of this is that Samsung are putting at risk an $8bn turnover for copying a customers phone design.
Even if Samsung win any of these suits, Samsung will lose the $8bn turnover, and will hand their component rivals the same amount.
The question at the end of the day is whether the Galaxy/Tab/S/S2 are really worth $8bn a year - which they aren't.
So who loses? Samsung every time.
Heres the clue - never sue your customer.

I kept working to be the meanest member but no one ever voted for me for that. :( ;)
I haven't seen any ruffled feathers yet, except maybe on the free merchandise spammers. It's alway fun to see the problems they have trying to insert a link to www.***********crap.com and www.freeipodcrap.com
They keep having to edit their posts, and while they're still typing www.free i p o d s . c o m they're already banned and tossed in the wasteland.
So I can see why they hate you guys. :D

Oh wow! Oh wait. I have four apps that already did all that when the iPad was first released. How about masks, brushes, stamp tools, and decent selection tools? Do they not know how far behind they are with this?
And all this debate over usefulness of the iPad. Forget it. If you are a creative professional and you have an iPad, and you haven't figured out to use it to make your work faster and better. I say you are lacking some creativity. I've been using the first iPad from day one for sketching, figure studies, portfolio reviews, etc. See for yourself on my website. It is no toy- if you know what you are doing.
