    Contract terms require "consideration" from both parties to be legally binding. Consideration is something you provide to the other party (i.e., money from you, data services from your carrier).

    What consideration are the carriers offering you for tethering? You're already paying $X for Y GB of data used on your phone. It doesn't matter to the carrier if your Netflix app is using it, or your tethering app is sending the data to your laptop. Nothing changes on their end, they just send the data that you've already paid for to your phone, and your phone handles the rest.

    You're right, it is black and white. It's a scam aimed at exploiting consumers like yourself who don't know any better, with an illegal contract term. I hope this goes to court soon, before the carriers in Canada (where I am) try to pull the same BS.

    They are offering you more bandwidth to use a higher bandwidth service like tethering.

    The consideration is very clear. Thanks for quoting the premise for contract law, but claiming there is no consideration there is ridiculous.

    People who tether use more bandwidth, so the cost associated with their usage is more expensive. The carriers can either charge those people for tethering or they can raise the price for EVERYONE.

    They choose to charge the people who tether. It is a perfectly reasonable choice on their part.

    Hey a cable line comes into my house with all the channels on it. I can just jimmy off a filter and get all the channels without paying any more. They are already delivering it to my house, why can't I just get all of them since they are there anyways and I am paying for cable right?

    You are not paying for tethering unless you are paying for tethering. The math is simple. People who tether use more bandwidth. Wireless providers set their data prices based on AVERAGE usage. Tethering makes the average usage go up, so the revenue to cover those costs has to come from somewhere.

    So they can either charge EVERYONE more or charge the people who tether more.. Again they choose the later.

    Came home from work today to find the window on my back door busted open and my Xbox 360 gone. They left the Wii, PS2, 32" Samsung LCD TV, stereo, MacBook, a ton of DVDs, CDs, and games. Just took the 360, 2 controllers, the XBox Live camera and some games.

    Called the cops, they came out, dusted for prints (didn't find anything good), tooks some pictures and wrote up a report. I still have all the reciepts for the 360 so I was able to give them the serial number and thanks to Delicous Library, I had a list of all the games that were stolen.

    Funny thing out of all of this: I had a set of Monster Cables for the 360 which force the system to run in HD. Whoever took it will have a nice surprise when they get it home and find out they can't run it on their SD set. (Kinda assuming they won't have an HD TV if they are stealing a 360...)

    But really now, who the heck does that?? A bunch of ********* kids I'm guessing. "Oh, lets steal the $400 Xbox instead of the $1500 TV or the laptop." What is this world coming to?? I live in a quiet neighborhood. The only thing I have ever seen a cop around here for is to break up a party down the road on New Years Eve. There are families with young children, a newlywed couple, a couple friends down the road. We all know each other, nobody has ever had a problem like this.

    The cops didn't give me much hope for recovering anything and I really wasn't expecting them to. It just really ticks me off that someone can have such little respect for someone else's property. Its not even a matter of the money, my landlord has good homeowner's insurance and he is a friend of mine so I think he will file a claim for me.

    Anyway, I just thought I'd post my little rant here and toss my gamertag out there. If anyone sees rtdgoldfish on Xbox Live, let them know they are a no good peice of ****** playing on a stolen system. Or if anyone knows how to track something like this, that would be great!

    Yes they do. BUT not when it means a crap ass experience for the customer. Because that just results in returns, complaints etc. LTE right now is only in a handful of major cities and not even perfect coverage there.

    Verizon's LTE covers about as many people now, as AT&T's 3G did back when the iPhone 3G came out.

    Apple is not just about pro-user experience. They also make decisions based on saving money (no 3G chip at first) and gaining market access (disabling WiFi for China at first).

    My understanding is that LTE is a whole new language, totally different from both CDMA and GSM. So phones would be, for a time, dual chips.

    In the same way there is 4g in the sense of 4th generation which is an improvement over the 3rd generation. and 4g which is 4th generation AND a particular minimum level of speed etc. And so say the naysayers, many folks saying '4g' mean the former and not the latter.

    Nice try, SavMan. But I'm not buying your interesting yet psuedoscientific explanation for why 5G iPods only 'appear' to scratch more easily.

    White 5G iPods are just as easily scratched as the black ones, as any disappointed owner will tell you. I've had a 4G iPod for 2 years, carrying it back and forth to work in my pocket. I take it out of a Belkin case to recharge it, then put it back in for transport. The thing still looks practically new. I know someone else who purchased a new white 5G iPod. Within moments of gentle handling, the thing is covered with light scratches.

    It seems to me that a softer grade of acrylic is being used on these latest iPods. I'm not the only one who's noticed this problem. I don't believe that it's the result of some optical coincidence. Everyone knows that there are hundreds (if not thousands) of complaints to be found on the net.

    Whatever the reason is, a manufacturer who doesn't care what their customers have to say about their expensive products will soon find those customers flocking to other companies' products. Hellooooo Zune!

    And no amount of fanboy cheerleading will stop it.

    Yeah, we moved to 57th place but there is pleasurdome and bitgamer right behind us :( some new guy, awachs, is making 10 mil a week :eek: his electric bill must be outrageous, must have a pile of gtx480's... and he will pass us in about 3 or 4 months.

    I've pre-ordered the Prestige Edition pack on the PS3. It's already been shipped and I will get it on Monday or Tuesday, shame really, cause I cannot open it until Christmas Day!!!!! hahahaha, oh I shall have to be strong..... but I thinks it's a cool pressy. I may play with the toy car more first though :D:D

    After that I implement a Cancel method pointing to sender (button)

    So, my goal is to use 1 start button and 1 cancel button.. and just do their actions. I have set up a the start button to start both timers, obviously both start their countdown at the same time which is not good.

    I want to tell one timer to start and if I press cancel, invalidate it. Then If I press start again, call the second timer. (I do this because I read that you can't reuse a timer after you invalidate it).

    Some people have suggested to use Booleans like true or false, or conditions. What do you think?

    What if after pressing the start button, you create a timer and start it. Then pressing the cancel button invalidates and releases it. Then pressing the start button would create another timer, using the same pointer.

    Totally untested and probably broken code below, but should demonstrate the idea:

    I've never heard myself say "Yo, Yo, wut up dude?" either, and yet I still like Kanye West. And you can't assume peoples musical tastes just because of their job or race. Computer people and reporters could have enjoyed the music as well. You can't say that they didn't with any certainty. I enjoy all sorts of music, and I'm sure many other people do as well.

    Actually, Profilers can say a lot about you just by looking where you work and what you do.
    Let me clarify that a bit more, as I have failed to do that before.
    Keynote is not a place for such lyrics/word to spoken/said by any one. THis is a place where people are serious about what they are doing and what is going on. After watching the whole keynote and then at the to see Kanye West was a big change in the whole mood in the room. Just take a look at the audience that was there, they all where stuned.

    P.S. my ost about Kanye West is bais, and is because i don't like hiphop/rap. Not because of artisits but because of the lyrics and that whole "gangster" attitude.

    well i got a new computer case and new cpu cooler last weekend, and today is the day i take one of my systems all the way down and build it back up.

    the case is a Cooler Master 922 HAF. it was on sale for $89. the cpu cooler is a silenx extreme silent cpu cooler effizio. wish me luck! :cool:

    Maybe VZW will bundle their only current 4G device -- the Mi-FI gizmo -- with a 3G CDMA iPhone 4. Would be similar to what they are doing with the iPad.

    Before you ask if VZW is stupid enough to do that, remember that VZW ninnies nixed the iPhone way back when.

    Interesting idea... sounds practical.. but the CDMA part is what I don't believe.

    Other than keeping applications in self-contained folders, I don't see any of this as copying. Even so, having applications run as self-contained folders isn't even an Apple idea.

    Different Microsoft IE versions for mobile phones, and computers? OH NOES!! :eek:

    Built-in PDF reader?! OMG!! What next, will Windows let you resize windows from all 4 corners rather than.......oh wait, it already does.

    yeah that was my though on it.
    Something like Time Machine was not even an Apple idea to begin with and I know MS has been working on it a very long time.

    I also know the built-in PDF reader has taken so long because of fears with Adobe. Hell to be able to save to PDF in Office MS had to make it an option to download it from them and install it. It could not be installed by default because of Adobe.
    Sounds like MS either is paying Adobe a small fee or they are done being scared. It is not like Acrobat reader is anything more than just a PDF reader. Something the OS as sorely needed built in.

    First, Apple must build an iPhone that will work on Verizon's CDMA network (iPhone is GSM & HPDA), OR Verizon must upgrade their network to handle GSM/HDMA. I don't thing either will ever happen.The former or both has to happen by next summer because there's no way Apple is going to continue letting AT&T keep their iPhone exclusivity past next July. In other markets where iPhones are being sold by multiple carriers, the iPhone's market share is radically higher. The same thing will happen here as soon as all the carriers are allowed to sell them.

    We're still at the beginning of this device's history. Imagine what it'll be like next Summer when there are 150,000 applications for the next version 4 iPhone with a dual core ARM processor running @ 1.6GHz with 64GB of RAM on board. ;) :D

    That one elicits a defensive, paranoid response while the other doesn't says more about the parent than the doctor.

    The NRA has so brainwashed their members that the boogeyman is gonna confiscate their guns that there has to be some hidden agenda in questions about firearms. The doctor are not turning you into some database, I promise. We just care about the safety of your child/

    This is kind of the way I see it. Doctors or any child-safety-related services person start asking questions, and the parents will gleefully talk about how safe everything in their house/car is (cleaners and poisons safely stored away, cabinets locked, access to pool is locked, car seats, etc). One question about guns and suddenly they go ape****** about how their privacy is being invaded. I see the whole gun-ownership thing as kind of a dick-waving exercise. Guys start talking about their guns and suddenly get very defensive and somewhat arrogant. Yes, that's my opinion....I have no source to cite.

    Damn then there must be something wrong with you Quad again Gary. I regularly use 1.1.2 on my 1.67 powerbook and I find it perfectly acceptable. And on my G5/X800XT it's super fast.

    I think the issue with people finding it slow is there lack of understand of what Aperture is actually doing. And also not really knowing how to use Aperture to it's full potential.

    Everybody wants everything to be instant but that will never happen.

    I for one find the workflow of cataloguing, correcting and exporting in Aperture far faster and superior then any comparable app.
    I have to say that I find Aperture acceptable on the MBP, but I guess if you are someone like iGary who uses this kind of software a lot, you notice it more and more.

    Hopefully the update will make a big difference in performance, especially when they now allow you to run it, whatever the (current) hardware you buy at the same time.

    True on the economies of scale bit - although the batteries are always going to be pricey.

    I keep hammering the same point here, but the Volt would see a quite significant fuel economy boost by switching to a diesel engine to charge the batteries and run the motors. Sort it out, US car companies...it's not like we don't sell diesel here.

    That is true. I'm surprised nobody has brought even diesel based hybrids here yet. I recall hearing VW was planning on it, but I don't remember where I read that.

    uh ok... "built in pdf reader... windows marketplace - providing users easy access to Windows applications." - never seen that in an operating system before...

    You mean like how Finder is finally adding cut and paste? Give me a break, there is plenty that Windows does that OSX does not do, like decent graphics support for one. It cuts both ways.

    Seriously Apple, how soon until the app store is the only way to install apps on your mac?

    If it's going to happen I hope it's soon. Photoshop CS5.5/6.0 will be out soon and I need to decide which platform will be my main one. It could go either way over the long term. My copy of PS CS3 for Windows will have to be updated to the next release in order to maintain upgrade privileges for Windows.
